Infringement Analysis of Parallel Imports in India

The IP arena saw a significant development in the legal discourse around parallel imports and infringement analysis with INTA filing an amicus curiae brief in a case currently pending before the Supreme Court of India. This case deals with the principle of International Exhaustion of trademark rights and raises fundamental questions on the rights of trademark holders versus parallel importers.

Background of the Case

In 2011, Samsung filed a trademark infringement suit against Kapil Wadhwa in the Delhi High Court for importing and selling Samsung printers in India without authorization. A Single Judge ruled in Samsung’s favor, stating that “the act of importation without the consent of the registered proprietor amounts to an infringement.”

However, on appeal, the Division Bench of the Delhi High Court reversed this ruling, recognizing the doctrine of International Exhaustion and allowing imports under specific conditions: the imported products had to be clearly marked as foreign goods, with no local warranty or service implied from Samsung. This judgment is now under challenge in the Supreme Court, where INTA has intervened as a friend of the court.

INTA’s Perspective on Infringement Analysis

INTA, in its submission, emphasized that trademark owners must retain the right to control the territorial commercialization of their goods unless they have explicitly waived this right. INTA argues that parallel importation often undermines the trademark owner’s ability to maintain consistent quality and pricing across jurisdictions.

It noted: “It is unreasonable to the trademark owner to hold that the goodwill is exhausted in all countries by use of the mark in just one country.” This view is central to infringement analysis, where protecting brand reputation and consumer trust is essential.

Indian Consumer Perception and Parallel Imports

In India, consumers often perceive imported products as superior, sometimes even paying premium prices for them despite local availability of the same products. This is particularly true for branded food items like Cadbury, Coca Cola, or Nestle chocolates, where imported variants are bought for reasons of perceived quality, not price.

Indian consumers are also generally aware of warranty issues tied to grey market goods, yet still opt to purchase them. According to the infringement analysis framework, this awareness may reduce potential consumer confusion, thus affecting how infringement is determined by courts.

The Legal Grey Zone

The enforceability of trademarks in the context of parallel imports in India remains unsettled. While other jurisdictions may follow strict national or international exhaustion regimes, India’s legal approach is nuanced, influenced by unique consumer behavior and trade patterns. Therefore, the question of whether parallel imports amount to trademark infringement in India is still a complex legal grey area.

Conclusion

This case highlights the intricate balance between trademark protection and market access. It reinforces the importance of clear infringement analysis when evaluating whether parallel imports harm brand owners or simply satisfy consumer demand in a globalized market.
