European Union Intellectual Property Office Affirms Thermax Limited’s Trademark Rights in Opposition Cases in the Czech Republic and Portugal

Thermax Limited, a leading provider of integrated solutions in energy, environmental, and chemical industries, has successfully protected its Intellectual Property Rights (IPR) in both the Czech Republic and Portugal. Represented by R. K. Dewan & Co., (RKD) Thermax secured favourable Orders in two trademark opposition cases, further strengthening its market position in European Union.

Czech Republic:

Thermax Limited is the registered owner of the trademark “ ” across multiple classes within the European Union, including key classes related to its operations. In January 2024, RKD filed an opposition on behalf of Thermax (Opponent) against a trademark application filed by Aquecinox Limited (Applicant) for the mark “ ” in the Czech Republic. The mark applied for was not only phonetically similar to the Opponent’s existing registrations but also sought registrations in Classes 17, 35, and 37, which overlapped with the goods and services covered under the Opponent’s existing registrations.In response, the Applicant argued that there were no similarities between the rival marks or their respective goods and services. However, RKD on behalf of the Opponent filed observations against the Applicant’s response in July 2024, highlighting the visual and phonetic similarities between the marks, as well as the overlapping nature of the goods and services. In August 2024, the European Union Intellectual Property Office (EUIPO) ruled in favour of the Thermax by refusing the Applicant’s registration of the mark “” in Classes 35 and 37 but allowed the mark to be registered in Class 17. Notably, the Applicant did not file an appeal against this decision, cementing the success of Thermax’s opposition in the Czech Republic.

Portugal:

Thermax Limited is also the registered owner of the mark “ ” in Class 11 across the European Union. In Portugal, Aquecinox Limited (Applicant) filed an application for a similar mark i.e., “ ” in the same Class i.e., Class 11. Given that Portugal is a member of the European Union, RKD, on behalf of Thermax, filed an opposition on based on Thermax’s prior EU registration.

The Portuguese Trademarks Office reviewed the case and issued a ruling outrightly rejecting the application in Class 11. The Registrar held that, there were substantial visual and phonetic similarities between the marks, along with a clear overlap in the goods covered under both applications, which could not only cause consumer confusion but also imply an association of the impugned mark with Thermax’s established goodwill & reputation. The Applicant did not appeal against the decision, confirming the success of the Opponent i.e., Thermax’s opposition in Portugal.

The favourable outcomes in the Czech Republic and Portugal highlight RKD’s expertise in defending and enforcing Thermax’s IPR which played a crucial role in cementing Thermax’s position in the international market. These recent successful orders underscore the importance of vigilant trademark protection and strategic legal approach in preserving the integrity of global brands as well as serve as valuable precedents for businesses to protect their intellectual property from potential infringement in international market.
