To commemorate World Intellectual Property Day 2025 and to promote awareness and capacity-building in the field of Intellectual Property Rights (IPR), the ICAR Central Institute of Fisheries Technology (ICAR-CIFT), Kochi, invited R. K. Dewan & Co. (RKD) to deliver a special presentation in May 2025.

The session commenced with Dr. Mohan Dewan (Trademarks & Patents Attorney, Principal – R. K. Dewan & Co.) sharing valuable insights on the protection of Intellectual Property in the fisheries sector.

He emphasized the critical need for safeguarding innovations and encouraged ICAR to advocate for the inclusion of specific fisheries technologies within the ambit of patentable subject matter, by submitting recommendations to the government.

Following this, Adv. Alka Varma (Senior Patent Attorney) elaborated on the importance of intellectual property rights, particularly in the context of the fisheries sector.

She highlighted how strategic IP protection can enhance the institute’s innovation potential and strengthen its IP portfolio, thereby contributing to the growth and competitiveness of the industry.

The organizers expressed their appreciation, noting that the presentation was highly insightful and instrumental in advancing their understanding of IP protection. R. K. Dr. Niti Dewan presided over the panel discussion and contributed to the occasion as a speaker, addressing the theme “Use of Innovation for Empowerment.” In her address, Dr. Niti Dewan highlighted how innovation serves as a powerful enabler for women in the IP field, providing new avenues for leadership, visibility, and impact. She addressed intriguing questions such as; “How does innovation play a role in empowering women within the Intellectual Property field?” and “What’s one innovative tool or strategy you wish existed to empower women in IP?” which led to a lively exchange of ideas around mentorship platforms, data-driven career insights, and collaborative knowledge-sharing ecosystems for women in IP law, science, and business.

This global networking event brought together IP professionals from diverse backgrounds and jurisdictions, fostering a space for dialogue, collaboration, and shared learning. Discussions centered on the challenges women face in the IP profession and the actionable steps that can be taken to foster greater inclusivity, leadership, and innovation.

R. K. Dewan & Co. was honoured to participate in the National Workshop on Advanced Legged Robotics (NWALR-2025), held in May 2025, at the Dr. A.P.J. Abdul Kalam Auditorium, DRDO Complex, Pashan, Pune. The firm was represented by Mr. Manish Gupta (Group Leader, Patents) and Adv. Bhushan Walunj (Patent Attorney), who engaged with leading experts in robotics, defence, and academia.

Organized by the Indian Society of Systems for Science and Engineering (ISSE) in collaboration with the Research & Development Establishment (Engineers), [R&DE(E)], DRDO, and COEP Technological University. It served as a platform to explore state-of-the-art advancements in legged robotics particularly bipedal and quadrupedal systems with applications across defence, healthcare, domestic environments, space missions, and industrial automation.

A major highlight of the event was the unveiling of DRDO’s humanoid robot prototype. Designed to assist in high-risk military scenarios, the robot equipped with advanced actuators, sensors, and control systems allow it to perform complex tasks such as gripping, obstacle clearance, and movement across rugged terrain. This development, targeted for completion by 2027, reflects India’s growing focus on integrating robotics into national defence strategies.
During the workshop, RKD’s associates actively contributed to discussions on how intellectual property rights intersect with robotics innovation. They emphasized the critical importance of a well-structured IP framework to protect pioneering technologies and promote continued research and development in this rapidly evolving domain.

Hon’ble Pune District Court Grants Ad-Interim Injunction in Favour of Dr. Bawasakar Technology (Agro) Pvt. Ltd. in Trademark Infringement and Passing Off case.

R. K. Dewan & Co. represented Dr. Bawasakar Technology (Agro) Pvt. Ltd. (Plaintiff) by filing a suit against Anannya Agro Products and Anr. (Defendants) for passing off its trade dress and trademark for the product “Germinator” and for infringing its registered trademark for the product “Harmony.”

The Plaintiff argued that the Defendants are unlawfully using the identical trademark ‘Harmony’ for an identical agricultural product. They further asserted that the Defendants’ product marketed as ‘Germinator’ employs a confusingly identical trademark and an almost identical visual presentation (trade dress) to the Plaintiff’s ‘Germinator’ product. This includes identical colour schemes, the use of Devanagari script in a comparable style, and overall packaging design for both the products.

The Plaintiff, emphasizing their established presence and recognition within the agricultural sector, presented evidence suggesting a strong likelihood of consumer confusion due to the substantive identical elements adopted by the Defendants. They highlighted the identical trademark for the ‘Harmony’ product and the identical trademark and trade dress for the ‘Germinator’ product. The Court, after reviewing the Plaintiff’s submissions, prima facie agreed that the similarities were significant enough to warrant interim protection.

Consequently, the Hon’ble Pune Commercial Court temporarily restrained the Defendants from continuing to use ‘Harmony’ trademark and the disputed trade dress associated with the ‘Germinator’ product by issuing an ad-interim ex-parte injunction in favour of the Plaintiff.

This initial triumph in the Pune Commercial Court underscores R. K. Dewan & Co.’s (RKD) successful and meticulous approach in safeguarding Dr. Bawasakar’s Intellectual Property. By strategically highlighting the striking visual and phonetic parallels between the infringing trademarks and Dr. Bawasakar’s well-established ‘Harmony’ and ‘Germinator’, RKD effectively demonstrated the high probability of confusion among agricultural consumers. This early, favourable ruling, securing a crucial ad-interim injunction, is a testament to RKD’s deep understanding of trademark law and their commitment to aggressively protecting their client’s valuable brand equity.

Hon’ble Delhi High Court Grants Ex-Parte Ad-Interim Injunction in Favour of Chalet Hotels Limited in Trademark Infringement and Passing Off Case.

R. K. Dewan & Co. represented Chalet Hotels Limited (Plaintiff) in a suit filed against Chalet Hospitality Services (Defendant) for trademark infringement and passing off concerning the use of its registered trademark “CHALET” and its variants.

The Plaintiff’s use of the mark “CHALET” dates back to 1999, for its well-known luxury hotel chains across India. The Plaintiff is also the registered proprietor of the trademark “CHALET” under multiple classes, including those related to hospitality services, and has acquired distinctiveness and goodwill through extensive and long-standing use. The Plaintiff filed the case against the Defendant by arguing that the Defendant had started using identical trademarks “CHALET”, “Hotel Chalet- Hotel in Saket”, and “Chalet A Unit of Kular Hotel” for hospitality services, hotel and banquet business which are identical to that of the Plaintiff.

The Plaintiff contended that the Defendant’s unauthorized use of identical marks in the same line of business amounted to trademark infringement and was likely to cause confusion and deception amongst consumers and public at large. After hearing the submissions, the Hon’ble Delhi High Court observed that a prima facie case of infringement and passing off has been made out by the Plaintiff. The Court also ruled that the balance of convenience lies in favour of the Plaintiff and that irreparable harm would be caused if ex-parte ad-interim relief was not granted.

Consequently, the Hon’ble Court granted an ex-parte ad-interim injunction, restraining the Defendant from using selling, soliciting, exporting, displaying, advertising and by any other mode/ manner dealing under the impugned marks “CHALET”, “Hotel Chalet- Hotel in Saket”, and “Chalet A Unit of Kular Hotel”. Further the Court appointed a Local Commissioner to visit the premises of the Defendant to seize, pack and seal the infringing products in compliance of the Court’s order.

This favourable ex-parte ad-interim Order by the Hon’ble Delhi High Court reinforces R. K. Dewan & Co.’s (RKD) expertise in protecting well-known marks in the competitive hospitality sector. By clearly establishing Chalet Hotels Limited’s prior rights, goodwill, and likelihood of consumer confusion, RKD successfully secured vital interim protection. The Order highlights the importance of trademark vigilance and strategic enforcement in preserving a brand’s identity and commercial value.
