R. K. Dewan & Co. Secured Ex-Parte Ad Interim Injunction for Safexpress Private Limited before the Hon’ble Delhi High Court

R. K. Dewan & Co. successfully represented Safexpress Private Limited (Plaintiff) before the Hon’ble Delhi High Court in a trademark infringement suit concerning the marks “Safexpress” and “Super Safexpress”.

In the proceedings, RKD on behalf of the Plaintiff contended that the addition of a laudatory prefix such as “Super” to a well-known registered trademark does not negate deceptive similarity. Instead, such modification is often an intentional attempt to ride on the goodwill and reputation of the Plaintiff’s brand.

The Hon’ble Delhi High Court concurred with these arguments, holding that, prima facie, the impugned mark “Super Safexpress” is visually, structurally, and deceptively similar to the Plaintiff’s mark “Safexpress”.

Accordingly, the Court granted an ex-parte ad-interim injunction, restraining the Defendants from using the impugned mark or any other deceptively similar variant thereof.

This outcome reflects R. K. Dewan & Co.’s continued commitment to the protection and enforcement of Intellectual Property Rights.
