The Trade Marks Rules, 2002 have been amended by way of a Notification published in The Gazette of India dated 1st August 2014 (“the Gazette”).Such amendment has been subsequently notified by The Controller General of Patents, Designs and Trade Marks vide its Public Notice dated 7th August 2014 (“the Public Notice”). Copies of the Gazette and the Public Notice can be made available by us at specific request.
By the Trade Marks (Amendment) Rules, 2014, the Government of India has increased the official fees for filing one trademark application (per mark, per class basis) from Rs.3,500/. (equivalent approximately to US Dollars 58) approximately to Rs.4,000/- (equivalent approximately to US Dollars 66) and for expedited examination of an application from Rs.12,500/- in respect of applications filed (equivalent approximately to US Dollars 205) to 20,000/-. (equivalent approximately to US Dollars 328). The amendment is with effect from 1st August, 2014.
We have accordingly revised our Trademark tariffs with effect from 1st August, 2014.
By the Public Notice the Office of the Controller General of Patents, Designs and Trade Marks has directed all applicants/agents who have filed trademark applications/requests for expedited examinations in respect of applications filed to tender/pay the applicable amounts towards deficiencies in fees (Rs. 500 towards trademark application(s) filed and Rs. 2,500 towards request(s) for expedited examination in respect of applications filed) between 1st August 2014 and 7th August 2014 on or before 30th September 2014 and failing which the Registrar of Trademarks shall not act upon such of the matters and until such additional / deficit fees are paid. The receipt of the deficiencies in fees after 30th September, 2014 shall result in the shifting of the filing date to the actual date on payment of balance fees. We confirm that we are doing the needful in this regard for such of our clients who are affected.
