Pune District Court Grants Interim Relief to Finolex Cables Ltd. in Trademark Infringement and Passing Off case.

R. K. Dewan & Co. (RKD) has been advising Finolex Cables Ltd. (Finolex) for over four decades now. The widespread popularity of products bearing the “FINOLEX” trademark has unfortunately led to a proliferation of counterfeit electrical cables marketed under identical or deceptively similar brand names.

In one such instance, RKD on behalf of Finolex, filed a suit for trademark infringement and passing off in the Hon’ble Pune District Court in January 2025. The suit was initiated against Mohan Electrical Works (MEW), an infringer using a similar trademark “Finoflex” in violation of Finolex’s registered and well-recognized “FINOLEX” mark.

Finolex’s TrademarkMEW’s Trademark

After hearing the submissions made by RKD on behalf Finolex at length, the Hon’ble Pune District Court observed that trademark infringement and passing off extends beyond the use of identical marks to encompass the use of similar trademarks that are likely to cause confusion among consumers. Consequently, in March 2025 the Hon’ble Court issued an ex-parte ad-interim injunction order in favour of Finolex, effectively restraining MEW from the continued use of the infringing “Finoflex” trademark.

This decisive legal action, secured through RKD’s strategic and effective Intellectual Property solutions, underscores the firm’s unwavering commitment to safeguarding the valuable goodwill associated with Finolex Cables Ltd.’s long-established “FINOLEX” trademark.

RKD Litigation Updates

Delhi High Court Grants Permanent Injunction to Sarvatra Technologies Pvt. Ltd. in a Trademark Infringement case.

R. K. Dewan & Co. (RKD), under the expert representation of Dr. Dewan, recently secured a significant success for Sarvatra Technologies Pvt. Ltd. (Sarvatra) in a trademark infringement case against Bharat Sanchar Nigam Limited (BSNL). Sarvatra, a prominent leader in India’s digital payment solutions, discovered the unauthorized and identical use of its registered “SARVATRA” trademark by BSNL for its Wi-Fi roaming services. This infringement posed a direct and substantial threat to Sarvatra’s established reputation and its position within the digital payment market.

In response to this infringement, RKD on behalf of Sarvatra initiated legal proceedings before the Hon’ble Delhi High Court, seeking a permanent injunction to restrain BSNL from the continued use of the “SARVATRA” trademark.

Represented by the legal expertise of Dr. Dewan and RKD, Sarvatra’s case was accorded an expedited hearing by the Hon’ble Delhi High Court. Recognizing the validity of Sarvatra’s claim and the potential for irreparable harm, the Court delivered a decisive judgment by granting a permanent injunction in favour of Sarvatra, thereby effectively restraining BSNL from any further use of the infringing “SARVATRA” trademark. Furthermore, the Court directed that necessary action be taken against any other unauthorized third-party entities found to be using the mark.

This order not only underscores the critical importance of prompt legal intervention and strategic planning in resolving Intellectual Property disputes but also reaffirms Dr. Dewan’s and RKD’s commitment to fiercely protecting the Intellectual Property rights of their clients.
